Maricopa County Attorney seeking second look at no-bail law

PHOENIX – Maricopa County Attorney Bill Montgomery is asking a federal court to take another look at its decision to strike down an Arizona law.

In October, voter-passed Proposition 100, which denies bail to some criminal offenders who are in the U.S. illegally, was found to be unconstitutional by the 9th Circuit Court of Appeals.

On Wednesday, Montgomery said he’s filed a request for the court to revisit the case.

“We have asked the 9th Circuit to review the Prop 100 case (and) we filed that petition this week,” he said.

Montgomery did not go into full detail as to the reasons why he is seeking a review but did claim that the court had “misread the applicable case law,” which could have affected its decision.

The decision made by the court is important because it could affect similar laws in many other states in the U.S., according to Montgomery.

“There are about 40 other states who have categorical denials of bail for certain types of offenses and, or defendants that would be impacted,” he said.
