Judge keeps death on the table in Jodi Arias murder case

PHOENIX — Convicted murderer Jodi Arias is still eligible for the death penalty after a judge denied a motion from her defense team.

Arias’ defense team alleged misconduct by the prosecution was grounds to dismiss death.

On Tuesday, transcripts from Arias’ secret testimony were released to some media outlets. Her lawyer, Kirk Nurmi, is quoted in the transcript as saying he was concerned about the media getting hold of the transcript.

Her testimony was halted after an appeals court overruled the unusual decision by Stephens to let Arias testify in private.

Prosecutor Juan Martinez didn’t get a chance to question her then, though he did so at her criminal trial. It’s unknown whether Arias will take the stand again.

The sentencing retrial, which had been expected to end in mid-December, is scheduled to resume Tuesday.
